Dog Bites

When a dog bites someone and causes injuries, the victim may bring an action against the animal’s owner for damages. Those lawsuits are mostly based on strict liability statutes –the dog owner is automatically liable for dog-bite injuries and there is no need to prove that the owner was negligent. However, there are exceptions that may limit the application of strict liability law. According to one-bite rule, the dog owner may avoid liability if his or her dog hasn’t performed dangerous tendencies in the past. Also, the plaintiff cannot be negligent in assuming the risk, or trespassing onto a property with a dog.
